These Terms of Service ("Terms") govern your use of Orca · Eye Training (the "Service"), operated by Clara Wong ("we", "us"). By purchasing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Orca is a home eye-training game designed to support visual training exercises (including but not limited to free space fusion and anti-suppression training) for children. Orca is a wellness and educational tool. It is not a registered medical device and is not intended to diagnose, treat, cure, or prevent any disease or visual disorder.
Always consult a qualified optometrist or ophthalmologist before starting any eye-training program. Orca is intended to be used alongside, not as a replacement for, professional vision care. Stop using Orca and consult your eye-care provider if your child experiences eye strain, headache, dizziness, nausea, double vision, or any other discomfort.
Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable licence to access and use the Service for non-commercial personal use within a single household, for the duration of your active access period (typically 3 months from purchase, unless otherwise specified).
This licence covers your personal use only. It does not grant you ownership of the Service or any rights beyond what is expressly stated in these Terms.

The Service — including all source code, design, layout, mascot character ("Orca"), images, illustrations, audio, copy text, training methodology as expressed in the Service, and the "Orca · Eye Training" name and logo — is the exclusive property of Clara Wong and is protected by copyright, trademark, and other intellectual-property laws of Hong Kong, the United States, and international treaties.

Your access key is personal. You are responsible for keeping it confidential and for all activity conducted under it. We may revoke any access key that we reasonably believe has been shared, leaked, resold, or used to circumvent these Terms, with or without refund.
If the Service does not work for your device or your child, contact us within 7 days of purchase at hello@orcasee.com for a full refund. After 7 days, refunds are at our discretion. Refunded licences are revoked upon refund.
We collect minimal data needed to deliver the Service (your email, your access key, and anonymised session metrics tied to that key). For full detail, see our Privacy Policy.
The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or any warranty arising from a course of dealing or trade usage. We do not warrant that the Service will be uninterrupted, error-free, or produce any specific clinical or training outcome.
To the maximum extent permitted by law, in no event shall Clara Wong / Orca be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Clara Wong / Orca from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.
We may suspend or terminate your access to the Service immediately, without notice or refund, if you breach any of these Terms — in particular, the restrictions in Section 4. On termination, your licence to use the Service ends and you must stop using it. Sections 4, 5, 9, 10, 11, 13, and 14 survive termination.
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles. You and we agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any dispute arising out of or relating to these Terms or the Service.
We may update these Terms as the product evolves. Material changes will be reflected in the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
